Relevant Ministries and Commissions of the Central Committee of the Communist Party of China, all Ministries and Commissions of the State Council and Organizations directly under the State Council, the General Office of the Standing Committee of the National People's Congress, General Office of National Committee of Chinese People's Political Consultative Conference, Supreme People's Court,Supreme People's Procuratorate, People's Organizations, Finance Bureau and Environmental Protection Bureau (Office) of all Provinces, Autonomous Regions, Municipalities directly under the Central Government, City specifically designated in the state plan, Finance Bureau of Xinjiang Production and Construction Corps:
In order to implement "Several Opinions of the State Council on Speeding up the Development of Circular Economy"(State Council document [2005] No.22), actively promote the development of environmental friendly society, perform the environmental protection policy function through governmental procurement, according to the "Government Procurement Law of the People's Republic of China"and "Environmental Protection Law of the People's Republic of China", following opinions about promoting governmental procurement of environmental labeling products are herein put forward:
1. Purchasing environmental labeling products is of great significance on setting a good image of the government on environmental protection, improving environmental protection awareness of the whole society, pushing the improvement of environmental protection technologies of enterprises, protecting environment and human health, saving resources, promoting the circular utilization of resources, and realizing sustainable development of the economy and society. Each region and authority should attach great importance on it, enhance organization management and supervision, and ensure practical implementation of governmental procurement of environmental labeling products.
2. The environmental labeling products should be purchased with first priority, and products which are harmful to environment and human health are forbidden to purchase, when all levels of state authorities, public institutions and group organizations (hereinafter as "purchaser") use financial fund to purchase products.
3. The Ministry of Finance and the State Environmental Protection Administration shall comprehensively consider the development of governmental procurement reform and technology and market of environmental labeling product. They shall identify the scope of preferential procurement according to the category from the environmental labeling products certified by the environmental labeling product certification organization accredited by the state, then release "Government Procurement List on Environmental Labeling Products" (hereinafter as "List").
The Ministry of Finance and the State Environmental Protection Administration will adjust the List in proper time, and issue it with the form of formal document.
4. The Chinese Government Procurement Network (http://www.ccgp.gov.cn/), the State Environmental Protection Administration network (http://www.sepa.gov.cn/), and China Green Purchasing Network (http://www.cgpn.cn/) are the public media of the List. In order to ensure the accuracy of the information above, the List shall not be transshipped without the permission of the Ministry of Finance and State Environmental Protection Administration.
5. The valid time of products in the List is determined by the valid date of the China Environmental Labeling Product Certificate, and product exceeding the expiration date will automatically lose its validity.
6. The purchaser shall purchase products in the List with priority, under the same condition of quality, technology and service, when purchasing variety is included in the List.
7. During the governmental procurement process, the purchaser or the entrusted procurement agency shall clearly specify the environmental protection requirements of the products (including building materials), the qualifications of eligible suppliers and products, and the evaluation standard for preferential procurement in the governmental procurement bidding files (including the negotiation documents and price-inquiry documents).
8. If the purchaser and the entrusted procurement agency do not purchase products according to above requirements, relevant authorities should give proper punishment according to relevant laws, regulations and rules, and financial authorities may refuse to pay the procurement fund according to actual situation.
9. The Opinion above will be actively implemented step-by-step, gradually extending across the country. It will be implemented from January 1, 2007 in the central and provincial budget units (including city specifically designated in the state plan) and be implemented in the whole country from January 1, 2008.
